Slip & Fall
Slip and Fall refers to accidents involving a slip, trip or fall due to hazardous or dangerous conditions that occur on an owner's property. The existence of a hazardous or dangerous condition doesn't necessarily render the owner liable for the personal injury of the person who has fallen. If the owner posted adequate warning, or if through the exercise of reasonable care, the owner had no knowledge of the hazardous condition, the owner would not be responsible. However, if either actual or constructive knowledge of the hazardous condition on the premises is established, the victim has a strong case. Additionally, if the owner or manager of the property created the defective or hazardous condition, liability exists. The issue often then becomes one of the damages suffered.
Some examples of circumstances where slip and fall accidents may occur include wet surfaces from water, snow, ice, and spilled substances, as well as poorly lit areas, rough, slick or uneven flooring, and hidden or obscured holes in the ground.
The length of time a spilled substance remains on a floor, ice remains on the sidewalk or steps in front of a building, or any hazardous condition persists without the proprietor taking reasonable action to remedy the hazard, directly affects the success in proving negligence in a slip and fall case.
