FELA (Railroad Cases)
In response to the great number of deaths occurring in the railroad industry, in 1908 the U.S. government passed the Federal Employers' Liability Act (FELA). FELA is a law that requires railroad owners to create a reasonably safe work environment at all times. A uniform liability standard has been established and railroad employees are assured compensation for personal injury suffered on the job.
If a worker is not covered by workers compensation, he may sue the railroad company under FELA. Discovering that an employer failed to meet standard safety regulations that resulted in personal injury is fundamental in proving a FELA case. Unlike workers compensation, which operates based on a pre-determined benefits schedule, FELA claims are tried by juries, based on railroad employer negligence in meeting set standards, and juries may render compensation judgments for pain and suffering.
Unlike many attorneys who litigate FELA cases, John Budin has a practical and unique understanding of how railroads operate due to his work as a "railroader." Unlike most attorneys, John has worked on the tracks and is proud to be a former "railroader."
