Dog Bite
Dog Bites are a growing concern across the U.S and people have suffered serious personal injury as a result of dog bites. The most common dog bite victims are children, who may suffer pain, trauma, emotional upset, disfigurement, and in extreme cases, death.
Illinois passed the Animal Control Act which maintains that, "If a dog or other animal, without provocation, attacks or injures any person who is peaceably conducting himself in any place where he may lawfully be, the owner of such dog or other animal is liable in damages to such person for the full amount of the injury sustained."
Under Illinois law, the owner is defined as the custodian of the dog and aside from the actual owner, may include someone caring for the dog or a kennel, but not the landlord of an apartment or tenement building that allows pets.
Illinois law also maintains that the owner is liable in a dog bite injury, if the dog is inclined to be dangerous and the owner had knowledge of the dog's dangerous nature, but was negligent.
